Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Khamsa, a software platform operated as a sole proprietorship by Saif Hegazy, based in Egypt (“Khamsa”, “we”, “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Service description

Khamsa provides software tools for restaurants and cafes, including QR-code-based review collection, digital menus, customer-facing payment requests, multi-staff dashboards, and AI-assisted Google review reply drafting. Khamsa is software-as-a-service; we do not own, operate, or take responsibility for the restaurants that use the platform.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into a binding contract to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

3. Subscription plans

Khamsa offers paid subscription plans (currently “Grow” and “Pro”) and a limited free demo. Plan features, pricing, and limits are described on the pricing section of thekhamsa.app. Subscription fees are billed in advance, are non-refundable except where required by law, and renew automatically until cancelled.

4. Customer payments

When a restaurant enables online payments, customer funds flow directlyfrom the customer to the restaurant’s own Paymob merchant account. Khamsa is not a payment processor, does not hold customer funds, and takes a 0% cut on customer-to-restaurant transactions. The restaurant is solely responsible for honoring the goods or services paid for, handling refunds, and complying with all tax and consumer-protection laws applicable to those transactions.

5. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law.
  • Submit false, misleading, defamatory, or harassing reviews or feedback.
  • Manipulate the rating funnel (e.g., filtering negative reviews while soliciting positive Google reviews) in a way that violates the policies of Google or any other platform you connect.
  • Attempt to access accounts or data that do not belong to you.
  • Reverse-engineer, scrape, or systematically extract the platform’s code or data.
  • Upload malware, abuse APIs, or attempt to disrupt the service.

6. Google review reply behavior

When you connect a Google Business Profile, Khamsa generates draft replies using AI. Youare responsible for reviewing and approving each reply before it is published to Google. Khamsa’s AI may produce inaccurate or contextually inappropriate suggestions; do not approve a reply you have not read. Khamsa is not liable for the content of any reply published from your account.

7. Customer-submitted content

Reviews, ratings, complaints, and other content submitted by your customers belong to those customers. By using Khamsa, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process such content as needed to provide the service to you. We do not claim ownership of your content or your customers’ content.

8. Service availability

We aim for reliable uptime but do not guarantee that the service will be available without interruption. Scheduled maintenance, third-party outages (Supabase, Vercel, Paymob, Google, etc.), and unforeseen events may temporarily affect availability. We are not liable for losses caused by such interruptions.

9. Termination

You may cancel your account at any time from the dashboard or by emailing hello@thekhamsa.app. We may suspend or terminate accounts that violate these Terms, that pose a security or legal risk, or that have unpaid invoices. Upon termination, your access to the dashboard ends; we may retain transaction records as required by law.

10. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, Khamsa’s total liability for any claim arising out of or relating to the service is limited to the amount you paid Khamsa in the 12 months preceding the claim, or USD 100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.

12. Indemnification

You agree to indemnify and hold Khamsa harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your content, your customers’ transactions, or your violation of these Terms or any law.

13. Governing law

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of Cairo, Egypt.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. Material changes will be communicated via email or an in-app notice. Continued use of the service after changes take effect constitutes acceptance.
