These Terms govern your use of Khamsa, the platform operated by Saif Hegazy operating as Khamsa (“we”, “us”, “our”). By using Khamsa, you agree to these Terms. If you don’t agree, please don’t use the service.
1. What Khamsa is
Khamsa is a software platform that helps Egyptian restaurants engage with their customers. We provide tools for digital menus, bill splitting, loyalty stamp cards, reward campaigns, and complaint management. We don’t operate restaurants ourselves — we provide software that restaurants use.
2. Who can use Khamsa
- You must be at least 13 years old.
- Restaurant owners must be authorized to act on behalf of their business.
- The information you provide at signup must be accurate.
3. Your account
- You’re responsible for keeping your password secure.
- Don’t share your account with others.
- If you suspect unauthorized access, tell us immediately.
- You can delete your account anytime from your settings. Deletion is permanent.
4. Using Khamsa as a diner
Khamsa is free for diners. By using it, you agree:
- To provide accurate information at signup.
- To use the service for its intended purpose.
- Not to abuse the system (faking visits, exploiting bugs, etc.).
Rewards (stamps, codes, etc.) are provided and honored by the participating restaurant, not by Khamsa. If a reward isn’t honored, contact the restaurant first. If the issue isn’t resolved, reach us at support@thekhamsa.app.
5. Using Khamsa as a restaurant
Subscription
- Subscription fees are agreed with each restaurant directly and billed annually in advance.
- We may change pricing with 30 days’ notice.
- Cancellation: you can cancel anytime from your settings. Service continues through the end of your paid period. After that, your customer-facing pages stop being publicly accessible.
- Refunds are at our discretion. We don’t usually refund partial months.
Free trial (Demo mode)
- New restaurants start with a 14-day free trial.
- During the trial: you can set up everything, but your customer-facing pages aren’t publicly accessible until you subscribe.
Responsibilities
- You’re responsible for the content you publish (menu, branding, campaigns).
- You’re responsible for honoring rewards your restaurant has promised to customers.
- You’re responsible for complying with applicable laws (food safety, advertising standards, etc.).
- You’re responsible for any customer data you collect through Khamsa, in compliance with Egyptian data protection law.
6. Acceptable use
You agree not to:
- Use Khamsa for illegal activity.
- Upload content that’s defamatory, hateful, infringing, or contains explicit material.
- Try to access other users’ accounts or data without authorization.
- Scrape, copy, or redistribute Khamsa’s content or design without permission.
- Use Khamsa to spam others.
- Reverse-engineer, decompile, or attempt to bypass security mechanisms.
Violation may lead to suspension or termination of your account.
7. Your content
- You own the content you upload (menu items, photos, branding, etc.).
- By uploading, you grant Khamsa a non-exclusive license to display, store, and process that content for the purpose of operating the service.
- We may remove content that violates these Terms.
8. Our intellectual property
- The Khamsa name, logo, software, and design are our property.
- We grant you a limited license to use the service under these Terms. We don’t transfer ownership of any of our IP.
9. Disclaimers
- Khamsa is provided “as is” and “as available.”
- We don’t guarantee uninterrupted service. We do our best, but outages happen.
- We don’t guarantee that Khamsa will meet your specific business goals.
- Use of the service is at your own risk.
10. Limitation of liability
To the maximum extent permitted by Egyptian law:
- Khamsa’s total liability to you for any claim related to the service is limited to the amount you’ve paid us in the 12 months before the claim (if any).
- We aren’t liable for indirect, consequential, or incidental damages.
11. Termination
- You can stop using Khamsa anytime.
- We may suspend or terminate your account if you violate these Terms or for other reasonable cause. When possible, we’ll notify you first.
12. Governing law and disputes
These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes will be resolved in the competent courts of Cairo, Egypt.
13. Changes to these Terms
We may update these Terms from time to time. We’ll post updates here. If changes are significant, we’ll notify you by email. Continued use of Khamsa after changes means you accept them.
